1. Who processes the data
The controller of personal data is StreamCharge, s.r.o., company ID (IČO) 22391762, with its registered office at Korunní 2569/108, Vinohrady, 101 00 Praha 10, registered in the Commercial Register kept by the Municipal Court in Prague, Section C, Insert 414146 (“we”). You can write to us at info@streamcharge.cz or by post to the address of our registered office.
We have not appointed a data protection officer, because the regulations do not require us to. Contact info@streamcharge.cz about any matter.
We comply with Regulation (EU) 2016/679 (GDPR) and Act No. 110/2019 Coll., on Personal Data Processing.
2. Who this policy applies to
- our clients, their representatives and contact persons,
- people whom a client invites to its project (administrators and team members),
- anyone who contacts us by email, by phone or in the chat,
- people whom our AI account manager calls or writes to on a client’s instruction,
- visitors to the website www.streamcharge.cz and to the Control Console.
Customers and guests of our clients: if you buy from an online shop or make a booking with a business that uses our platform, that business is the controller of your data. We process the data only as its processor and on its instructions. You will find the details in the privacy policy of the business concerned.
3. You are communicating with artificial intelligence
In the chat, by email and by phone, the AI account manager deals with you on our behalf. It is artificial intelligence, not a person. On the phone it speaks with a synthetic voice. Its replies are produced by the Claude language models from Anthropic. Changes to websites are made by the AI developer.
People at StreamCharge supervise the AI’s work. You can ask at any time for a person to review your matter.
The AI does not make decisions about you that would have legal effects for you or similarly significantly affect you (Art. 22 GDPR).
4. What data we process
- Identification and contact details: name, company, email, telephone and your role in the project.
- Communication: emails and their attachments, chat messages, SMS messages, transcripts and audio recordings of telephone calls, in each case with the time and channel.
- The AI account manager’s notes: what is useful to remember, for example your preferences, arrangements and what you tell us yourself; also your time zone, language, when it suits you to be called and when you are away.
- Project data: assigned tasks and their results, documents and files, the content and source code of the website, the history of published changes.
- Sign-in: the email address to which we send the one-time code, the time of sign-in and the version of the terms in force at that moment; a remembered device, if you use one. We store the code itself only as a cryptographic hash.
- Payments: credit balance and movements, payments and accounting documents.
- Technical data: IP address and request data in the server’s operational logs.
We obtain data mainly from you. The data of team members is passed to us by the client that invited them to the project. The data of people whom the AI account manager calls or writes to on a client’s instruction is passed to us by that client.
Providing data is voluntary. However, without contact details we cannot provide you with the services.
5. Recording of telephone calls
We record and archive telephone calls with our AI account manager. This applies to incoming and outgoing calls, including calls that the AI conducts with other people on a client’s instruction. We store the audio recording and a transcript of the call.
- Why: so that we have a reliable record of what you requested and what we agreed (orders, approvals, prices), so that we can resolve unclear points and disputes, and so that we can find and correct errors made by the AI.
- Legal basis: our legitimate interest (Art. 6(1)(f) GDPR); for clients, also performance of a contract (Art. 6(1)(b) GDPR).
- Notice: we tell you about the recording at the start of the call.
- Objection: you can object to the recording, during the call or at info@streamcharge.cz. We will then delete the recording of your call, unless we need it for the defence of legal claims. You can also send us your request by email.
- How long: the audio recording for 12 months from the call. We keep the transcript like other communication (section 9).
- Who is involved: calls are carried by Telnyx, speech is converted to text by Soniox (with Gladia, Groq or ElevenLabs as a fallback), the AI’s voice is generated by ElevenLabs, replies are produced by Anthropic and we store the recordings in Microsoft Azure.
6. Why we process data
- Providing the services and performing the contract (Art. 6(1)(b) GDPR): communicating with you, assigning and carrying out work, operating websites and the Control Console, sign-in, credit.
- Contract negotiations (Art. 6(1)(b) GDPR): replies to enquiries.
- Business communication (legitimate interest, Art. 6(1)(f) GDPR): we answer the questions you send us.
- Dealing with a client’s request (the client’s legitimate interest and ours, Art. 6(1)(f) GDPR): the data of team members and of people whom the AI calls or writes to on a client’s instruction.
- Accounting and taxes (legal obligation, Art. 6(1)(c) GDPR).
- Security and protection against misuse (legitimate interest): operational logs, limiting the number of sign-in codes sent.
- Enforcement and defence of legal claims (legitimate interest).
We do not send newsletters or advertising emails.
7. Who we share data with
We do not sell personal data. We pass it on only to:
- processors who operate the services for us (listed below),
- persons who provide us with accounting, tax and legal services and are bound by a duty of confidentiality,
- authorities and courts, where the law requires it.
Our processors:
- Microsoft Ireland Operations Limited (Ireland): the Microsoft Azure cloud – running the services, databases, storage and backups; data is stored in the West Europe region (Netherlands).
- Anthropic, PBC (USA): Claude language models.
- Telnyx LLC (USA): telephone calls and SMS messages.
- Soniox, Inc. (USA): speech-to-text conversion; as backups, Gladia SAS (France) and Groq, Inc. (USA).
- Eleven Labs, Inc. (ElevenLabs, USA): the AI’s synthetic voice and backup speech-to-text conversion.
- INTERNET CZ, a.s. (FORPSI, Czech Republic): email.
- GitHub, Inc. (USA): the source code of projects and the automatic deployment of websites.
What each processor does is described in more detail in the data processing terms.
8. Transfers outside the EU
Some processors are based in the USA. We transfer data to them on the basis of the European Commission’s decision on adequate protection (EU–US Data Privacy Framework) where the recipient is certified, and otherwise on the basis of the European Commission’s standard contractual clauses (Art. 45 and Art. 46(2)(c) GDPR). We will provide you with a copy of the clauses on request.
9. How long we keep data
- Communication with clients (emails, chat, call transcripts) and the AI account manager’s notes: for the duration of the cooperation and 3 years after it ends.
- Communication with others (enquiries and questions): 3 years from the last contact. We then delete it permanently.
- Audio recordings of calls: 12 months from the call.
- Chat without sign-in: we delete the text of messages after 7 days and the record without the text (time and channel) after 90 days.
- Sign-in codes: we delete them within 2 days after they expire; the record of a code being sent within 3 days.
- Sign-in to the Control Console: valid for 12 hours. A remembered device stops being valid 180 days after it was last used.
- Project data: for the duration of the contract and 30 days after it ends, so that the client can request it; we then delete it.
- Accounting and tax documents: for the period required by accounting and tax regulations, for no more than 10 years.
- Server operational logs: for no more than 90 days.
- Backups: for no more than 30 days. After that period, data that we have deleted in the meantime disappears from them as well.
10. Cookies and browser storage
The website www.streamcharge.cz does not use cookies or analytics and advertising tools, does not store anything in your browser and does not load third-party content.
The Control Console does not use cookies. It stores in your browser’s storage only what it needs in order to work: the sign-in (valid for 12 hours), the selected project, the view, the colour mode and technical data for loading the page correctly. Without that, the console would not work as you have asked, so we do not need your consent for it (§ 89(3) of Act No. 127/2005 Coll., on Electronic Communications). You can remove the stored data by clearing the site data in your browser.
The server that delivers the pages necessarily processes your IP address and request data. For security reasons, they may be included in operational logs (section 9).
11. How we protect data
We store data in Microsoft Azure data centres in Western Europe, encrypted both in transit and at rest. You sign in to the Control Console with a one-time code sent by email. Everyone sees only the projects they have permission to access. The data processing terms give further details.
12. Your rights
You have the right:
- to access your data and to obtain a copy of it,
- to have inaccurate data corrected,
- to erasure,
- to restriction of processing,
- to data portability,
- to object to processing based on legitimate interest, including the recording of calls,
- to withdraw consent, where processing is based on consent,
- to lodge a complaint with the Office for Personal Data Protection, Pplk. Sochora 27, 170 00 Praha 7, www.uoou.cz.
Send your request to info@streamcharge.cz or tell the AI account manager. We will deal with it within one month. To avoid giving your data to someone else, we may verify your identity, for example with a code sent to your email address.
On erasure, we delete your data from all records. We keep only what the law requires us to keep (for example accounting documents) or what we need for the defence of legal claims.
13. Changes to this policy
We may update this policy. We will publish the new version on this website with its effective date. We inform clients of material changes by email.
